This Terms of Service is produced by Wych Way Studios Ltd (“we”) for users (“you”) of our products and services (“services”). You should not use our services unless you agree to the Terms of Service and you also agree to your data being processed in the manner laid out in the Privacy Notice document.
Our services are provided for personal entertainment purposes. They should be used for no other purpose than the exceptions of (i) to make critical analysis and (ii) to make “Let’s Play” style videos/streams. If you do not agree to the terms laid out in this document, we do not allow you to use our services.
You represent that you have the legal capacity to be able to agree to these terms and understand that they are governed by the laws of the United Kingdom and any dispute is to be held in the courts of the the United Kingdom. You agree that the use of our services is for personal use only and that any personal information you provide to us must be your own.
We may change, terminate or suspend access to our services at our discretion at any time and without prior notice. Any provisions of these terms which by their nature are not limited to the availability of service and should continue past termination will do so, in particular but not limited to Ownership of Service, Limitations of Liability and Indemnity.
We own our services entirely and retain full control over their use. Copyright is fully upheld wherever it applies. You may not present yourself or anyone else as owner or manager of our services. You may not make any copies or derivatives of our services. You may not use any of our services or content in any way other than the intended use as laid out in this document. Some of our content may be attributed to others and we do not claim ownership, control or responsibility for this content.
You accept that you use our services entirely at your own risk. We can not be held responsible for any harm or loss to yourself or others, any damages to any property or any legal repercussions resulting from the use or improper use of our services.
While we take reasonable steps to secure our services from malicious intent, we can not guarantee that the services are free from viruses or other malicious content and we can not fully guarantee the security of any data you provide to us. You agree that we are not responsible for the results of malicious actions by 3rd parties, including but not limited to financial loss and the release or loss of data you have provided to us.
Our services may contain links to 3rd party services which we have no control over. As such we can not take responsibility for their content, privacy policies, or practices. Our Limitations of Liability apply to the use or improper use of these 3rd party services and any reliance on the availability of their services which we can not guarantee.
Our services are provided by humans and mistakes can happen. By using our services you agree that this is the case and accept the risk; we do not take any responsibility for any loss or damage caused by mistake or negligence by us or 3rd parties.
Our services are provided on an “As Is” basis. We do not represent or guarantee any level of service to you. We may alter anything about the services at any time including the type, content and availability.
Our services are provided on an “As Available” basis. We do not represent or guarantee that our services will be available at all times or be available at any time at all. We are not responsible for any loss or damage caused by our services being unavailable.
To the maximum extent permitted by law, you agree to defend, indemnify, and hold Wych Way Studios Ltd, its officers, directors, employees and agents, harmless from and against any and all claims, actions, suits or proceedings, as well as any and all losses, liabilities, damages, costs and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with: (i) your access to or use of any of our services; or (ii) your violation of the terms.
If any provision of these terms is held invalid or unenforceable, that provision may be modified to the extent necessary to render it enforceable without losing its intent. If no such modification is possible, that provision will be severed from the rest of this agreement. If we do not enforce any right or provision of terms it is not to be deemed a waiver of our right to do so in the future.
We reserve the right to change this Terms of Service from time to time to better reflect the current circumstances. Any changes will be made visible by revising the date at the top of this document. We encourage you to review the Terms of Service whenever you access or use our services in order to understand the conditions of use. If you use our services we must assume that you have consented to the most up to date Terms of Service.
